The former personal attorney for Donald Trump has stepped down as the chief federal prosecutor in the state. This decision was prompted by a judicial decision that invalidated her right to hold the office.
Acceptance of Resignation
The head of the Justice Department, Pam Bondi, announced Habba's resignation on the start of the week. In a statement that the judicial decision made it "untenable" for Habba to perform her duties.
"Do not interpret compliance for surrender," Habba stated. "My fight will now extend throughout the nation."

The departure follows closely on a US appeals court ruled that she had been acting without proper authority as the top prosecutor. This judgment is expected to impact scores of legal proceedings in the state.
The appellate judges declared that a temporary posting that did not receive confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.

Bondi said that Habba will remain at the DOJ as a top consultant. Habba plans to seek further review of the disqualification, aiming for a different outcome.
In a statement, she wrote that the judiciary "cannot be permitted to second-guess the executive's selection of lawyers entrusted with performing the executive branch's core responsibility of criminal prosecution."

The attorney general praised her tenure and pointed out that during her run, the city of Newark saw a one-fifth decrease in crime. Additionally that the Camden recorded its initial homicide-free summer since 1974 without a homicide.
